Please note that by accepting and submitting an order form and paying a deposit, you agree to be subject to these Terms and Conditions.

Please read the following Terms and Conditions carefully before placing your order with SWEETSBYSIMI. We reserve the right to refuse the sale of goods or services or to cancel an order under certain circumstances. Please note that all photos taken of cakes prior to delivery/pickup remain property of SWEETSBYSIMI.

In this terms and conditions, “We”, “Us” and “Our” refers to SWEETSBYSIMI.

DEPOSIT INFORMATION

Please note: A 50% non-refundable deposit is required to confirm the order. The balance is due BEFORE the day of pickup/delivery. Orders will not be delivered or completed unless payment has been made in full.

If placing a RUSH order, payment in FULL is required.

An invoice will be emailed to you shortly after the form is submitted. You will have 2 days to respond by paying the invoice. If we do not hear back from you within 2 days, your order form will be canceled. Please check your junk folder if you have not received your invoice.

CANCELLATION/CHANGES

All cancellations/changes must be received in writing.

If SWEETSBYSIMI must cancel an order with you for any particular reason due to health, family or situations out of our control, a full refund will be provided to you, as well as assistance in finding a suitable decorator with similar experience to complete your order.

We ask that all changes are made prior to our two-week cut off period.

PICKUP/DELIVERY

Pickup/delivery times are not guaranteed and will be scheduled on availability.

We offer delivery at a cost and will require an address from you to be able to provide a quote for you. We use Uber package for our deliveries and these deliveries will only be made within reasonable business hours.

If you or your representative choose to pick up and set up your cake, you assume all liability and responsibility for the condition of the cake once it leaves our premises.

PRODUCT INFORMATION

The images on the website are examples of our cakes. All our products are hand made and can be ordered in different sizes from those shown on the website, your cake may have variations from the website image.

Please note that certain figurines and decorations we use in our cakes may contain wire or toothpicks which are dangerous if consumed.

Please note that if a picture/image is provided, we can only try to duplicate what we can as certain products/items on the cake may not be available.

Our products may contain or come into contact with milk, wheat, nuts, soy, and other allergens. You agree to notify your guests of this risk and will not hold SWEETSBYSIMI liable for allergic reactions.

STORAGE

Cakes should be stored in a cool dry place, preferably in the box they were supplied in. Refrigeration may cause colors to run/bleed.

Please keep all cakes and out of direct sunlight. Failure to do so could result in melting, cracks and color bleeding.

VIEWING

Please do not request images of cakes prior to pickup/delivery, we do not offer this service as processing orders are our priority and we are always busy. Thank you for your understanding.

DISCLOSURE OF INFORMATION

SWEETSBYSIMI will not disclose any personal information such as your name, address, email or telephone number to any person outside of the company, unless the customer has authorized us to do so or unless required by law to disclose such information.
Furthermore, under no circumstances will SWEETSBYSIMI sell or receive payments or services for disclosing customer’s personal information to any partner or external company.
